Disclaimer
The developer tunnel service (hereinafter referred to as the "Service") is provided by its operator, hereinafter referred to as the "Company" or "we" (whose specific entity shall be the contracting party as defined in the Developer Service Agreement). To safeguard your rights and clarify the scope of service and liability, the Company hereby makes the following statement regarding the Service. Please read and fully understand the Developer Service Agreement and this Disclaimer carefully before using the Service. By using the Service, you are deemed to have read, understood, and agreed to all the above terms. If you do not agree to any part of the above terms, please do not use the Service.
Note: The terms highlighted in bold in this Disclaimer are terms of significant interest concerning your rights and interests (including, but not limited to, terms that exclude or limit the Company's liability, restrict your rights, or increase your obligations). Liability exclusions and responsibility shifts are marked in bold, while definitions, examples, and provisions favorable to you (such as liability that may not be excluded or limited by law) remain in regular weight, so that you can quickly locate the key terms.
I. Service Description and Disclaimer
1.1 Service provided "as is": The Service is provided on an "as is" (AS IS) and "as available" (AS AVAILABLE) basis. The Company makes no express, implied, or statutory warranty as to the availability, continuity, stability, security, timeliness, accuracy, completeness, or fitness for a particular purpose of the Service. The Service is provided free of charge and without any Service Level Agreement (SLA) guarantee. You shall evaluate and assume on your own the risks and consequences arising from your use of the Service, including but not limited to data loss, business interruption, and equipment damage.
1.2 Non-production use: The Service is designed for development and testing scenarios, such as local prototype development, mobile testing, and remote debugging (non-production environments). Do not use the Service for core business systems in production environments or for scenarios involving critical data or high-availability requirements. Any loss or liability arising from your unauthorized use of the Service in a production environment shall be borne solely by you, and the Company assumes no liability therefor.
1.3 Service availability and changes: The Company may adjust Service features, restrict usage conditions, or terminate the Service based on operational needs, but will notify you within a reasonable period through appropriate means. The Service may be interrupted due to maintenance, technical upgrades, force majeure, or other reasons, and the Company assumes no liability therefor.
II. User Responsibilities and Restrictions
2.1 Your own responsibility for security:
- You shall assume all security responsibilities arising from your use of the Service, including but not limited to setting strong passwords, controlling access permissions, defending against network attacks, and ensuring data security.
- If data leakage, device intrusion, malware infection, or other consequences arise from your misconfiguration (such as enabling anonymous access), security negligence, or failure to take reasonable protective measures, you shall be solely liable, and the Company assumes no liability therefor.
- Although the Service adopts TLS encryption and authentication mechanisms, the Company cannot guarantee that your local service will never be attacked or that data will never be intercepted (Data Interception, i.e., a third party illegally intercepting, monitoring, or tampering with data during its transmission between your local computer and the public network), and you shall evaluate on your own the risks of transmitting sensitive data.
2.2 Prohibited use: You shall not use the Service to host malware, phishing sites, infringing content, or to engage in activities that violate local laws and regulations (such as disseminating illegal information, infringing upon the rights of others, network attacks, etc.), or for any prohibited commercial use. If the Company has reasonable grounds to believe that you have engaged in any of the foregoing, it may, after verification and notice, take measures such as restricting or terminating the Service, and reserves the right to pursue legal liability.
2.3 Compliance requirements: You shall ensure that your use of the Service complies with the compliance requirements and security standards of your industry and organization, and any liability arising from your failure to meet such compliance requirements shall be borne by you.
III. Limitation and Exemption of Liability
Liability that the Company is required by law to assume, including liability for personal injury caused to you and liability for property damage caused by the Company's willful misconduct or gross negligence, is not affected by this Disclaimer.
3.1 To the maximum extent permitted by applicable law, the Company assumes no liability for any loss, damage, data loss, or loss of profits directly or indirectly caused by any of the following:
(1) interruption, delay, suspension, or termination of the Service;
(2) loss, corruption, leakage, or tampering of data during transmission;
(3) network attacks (including but not limited to DDoS, intrusion, and hijacking), computer viruses, or third-party service failures;
(4) fault, improper operation, or unlawful acts of users or third parties;
(5) force majeure, including natural disasters, war, strikes, government actions, changes in laws, regulations or policies, and failure of basic telecommunications facilities.
3.2 Given that the Service is provided free of charge and you have paid no consideration, to the maximum extent permitted by applicable law, the Company's liability for any direct, indirect, incidental, special, consequential, or punitive damages arising from the use of or inability to use the Service is limited to the fees actually paid by you during your use of the Service.
IV. Governing Law and Dispute Resolution
This Disclaimer shall be governed by and construed in accordance with the laws of the People's Republic of China; if the Developer Service Agreement provides otherwise regarding governing law, dispute resolution, or jurisdiction, such provisions shall prevail.
